Default Rear Brake Seizing up

Hi

Is a 2001 txt249 supposed to have some sort of spring on the rear brake lever? I have just bought the bike, and the rear brakes start sticking after a few minutes of riding. I can't see any place for a spring, but there is an adjustment nut/bolt at the top of the lever, but the lever is not touching this. It looks as though something should be pulling the lever upwards against the adjustment bolt? So i guess the brakes are maybe dragging all the time (although not apparent if you push the bike when cold) but after a while they seem to get very hot and there is a lot of drag on the back brakes?

Any advice appreciated
